NOTICE OF REQUEST FOR PROPOSALS 
FOR THE PROVISION OF MUNICIPAL ENGINEERING SERVICES

Notice is hereby given that sealed Proposals will be received by the Borough of Fair Lawn (“Borough”), 8-01 Fair Lawn Avenue, Fair Lawn, New Jersey, Room 206, on Tuesday, May 21, 2024 at 12:00 p.m. prevailing time for the following Professional Services, at which time and place the Proposals will be opened: Municipal Engineering Services

Proposals must be submitted on or before the foregoing date and time on the Proposal Forms furnished in this Request for Proposals (RFP) and delivered in a sealed envelope clearly marked on the outside:  “RFP for Municipal Engineering Services.”   The name and address of respondents must also appear on the outside of the sealed envelope.  Proposals must be mailed or hand delivered to the Municipal Clerk’s Office at the above address.  Faxed or emailed Proposals will not be accepted.  

Proposals prepared on forms other than those provided in the RFP may be rejected. Proposals received after the date and time set forth herein, regardless of cause of delay, will not be accepted but will be returned unopened.  

The RFP, including the Proposal Forms and Scope of Services, may be obtained from the Municipal Clerk’s Office at the Borough of Fair Lawn Municipal Building at the above address during regular business hours, Monday through Friday, 8:30 a.m. to 4:30 p.m. or by emailing bids@fairlawn.org.

The Borough has structured this procurement as a fair and open process to assure that all Respondents are provided an opportunity to submit Proposals and be considered for selection based on the evaluation criteria set forth in the RFP.  

Respondents are required to comply with the affirmative action and non-discrimination provisions of N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27.

The Borough reserves the right to waive any informalities or irregularities in the Proposals received and to reject any and all Proposals, pursuant to applicable law.

NOTICE TO BIDDERS
Second Street Storm Drainage and Bank Stabilization

TAKE NOTICE that sealed bids will be received by the Borough Clerk for the Borough of Fair Lawn (the “Borough”), Bergen County, New Jersey at the Municipal Building, Council Chambers, 8-0l Fair Lawn Avenue, Fair Lawn, New Jersey 07410, on Tuesday, June 11, 2024 at 10:00 a.m., prevailing time, at which time bids will be opened and read aloud for Second Street Storm Drainage and Bank Stabilization as more fully described in the bid documents. 

No bids will be received after the date and time set forth above.

Bidders shall submit one (1) original and two (2) copies of their bids by certified mail, overnight or express mail or hand-delivery, in a sealed envelope, addressed to the Borough Clerk’s Office at the address above, and clearly marked on the outside with the bidder’s name and address and bearing the words “Public Bid: Second Street Storm Drainage and Bank Stabilization.” All bids must be received by the Borough Clerk’s Office on or before the date and time set forth above.  Bids received by the Borough will be date and time stamped upon receipt.  Bidders are solely responsible for the timely delivery of their bids and any bid received after the date and time specified above will not be considered but will be returned unopened to the Bidder. No bidder may withdraw its bid within sixty (60) days after Bid opening. 

Prospective bidders must contact the Borough Clerk’s Office, telephone 201-794-5340, between the hours of 8:30 A.M. and 4:30 P.M., Monday through Friday, excluding legal holidays, or by emailing bids@fairlawn.org, to arrange for pick-up or mailing the bid documents to prospective Bidders.  The Borough accepts no responsibility for timely delivery of the bid documents.

Copies of the bid documents will be available for a non-refundable charge of fifty (50) dollars after the Bidder registers with the Borough.  NO BIDS MAY BE SUBMITTED ELECTRONICALLY.  Each bid must be submitted, in writing, on the bid forms furnished in the bid specifications.

A certified check, cashier’s check or bid bond in the amount of ten percent (10%) of the bid, but not in excess of Twenty Thousand Dollars ($20,000), must be submitted with the bid, guaranteeing that if a contract is awarded, the bidder shall execute the contract and deliver the bond(s), if any, required by the bid documents. The bid bond shall be obtained from a surety company that is authorized to do business in the State of New Jersey.   Such Bid Bond shall not contain any conditions to the obligations of the surety company issuing the Bid Bond.  Bid Bonds signed by an Attorney-in-Fact shall be accompanied by an executed and certified Power-of-Attorney.

Bidder shall submit with the bid a Consent of Surety with Power of Attorney from a Surety authorized to do business in the State of New Jersey, in a form acceptable to the Borough, stating that the Surety will provide the bonds required by the bid specifications. The Consent of Suety shall be obtained on behalf of the bidder, any or all subcontractors or by each respective subcontractor or by any combination thereof, which results in performance security equal to the total amount of the contract, pursuant to N.J.S.A. 40A:11-22. The Consent of Surety shall include a valid Power of Attorney authorizing the Attorney-in-Fact to execute the documents. Failure to submit a Consent of Surety form shall result in rejection of the bid.               

Bidders are required to comply with the requirements of N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27-1 et seq. All bidders and any named subcontractors must be registered with the Department of Labor and Workforce Development pursuant to the Public Works Contractor Registration Act at the time the bidder’s bid is submitted, and bidders shall submit the Public Works Contractor Registration for itself and all named subcontractors prior to the award of a contract by the Borough. Any unnamed subcontractor must be registered with the Department of Labor and Workforce Development prior to starting work.  The successful bidder shall submit copies of its New Jersey Business Registration Certificate(s) for itself and for all subcontractors prior to award of a contract.

Contractors shall be advised that this project is being partially funded by Green Acres in coordination with municipal funds and all requirements of the program must be followed by the contractor in the performance of this contract.

 The Borough reserves the right to reject any or all of the bids or waive any informalities therein pursuant to and in accordance with applicable law.
